These terms govern use of missourisingle.com and bookings for recreational diving activities supplied by Dive Beyond LTD under the Sounding Line Diving brand.
1. Scope and supplier
The supplier is Dive Beyond LTD, Castletown, Portland DT5 1BD, trading on this website as Sounding Line Diving. Email: [email protected]. Telephone: +44 7133 269935. VAT number: GB 335962968.
These terms apply to enquiries, confirmed bookings and the use of this website. They should be read together with any written booking confirmation, package inclusions, safety information and site-specific instructions sent to you. If a written confirmation contains a specific arrangement that differs from a general statement on the website, the written confirmation applies to that booking.
2. Enquiries and when a booking is formed
Submitting the website form is a booking enquiry, not a confirmed reservation. We review the requested date, package, group size, declared experience and any equipment needs before confirming availability. A booking is formed only when Dive Beyond LTD issues written confirmation and any payment requirement stated in that confirmation has been satisfied.
You are responsible for checking that the package, date, number of divers and information in the confirmation are correct. If something is wrong, tell us promptly so that we can determine whether it can be changed.
3. Prices, VAT and payment
The package prices displayed on the main page are stated as total consumer prices and include VAT at 20%. Each package explains its base inclusions and any material exclusions. We do not add an undisclosed booking surcharge to those listed package prices.
Optional items such as personal equipment hire, specialist gases, additional cylinders, accommodation, transport, media packages or other extras are not included unless the package expressly says otherwise. If you request an optional extra, its price and tax treatment are given before it is added to the booking. Payment timing and accepted method are stated in the written confirmation.
4. Qualifications, fitness and suitability
Different activities require different experience and qualifications. You must provide accurate information about your training, recent diving and equipment where requested. A qualification does not automatically make every site or depth suitable on every day. The final dive plan takes account of conditions, recent experience, equipment and the judgement of the person responsible for the activity.
You may be asked to complete or confirm a health or fitness questionnaire before entering the water. If a response indicates that additional medical clearance is needed, participation may be postponed until suitable clearance is available. Do not withhold information that could materially affect safe participation.
5. Weather, sea conditions and operational changes
Diving is weather- and condition-dependent. Tide, wind, sea state, visibility, access, equipment availability and other operational factors can require a change of site, timing, depth or planned route. A change made for safety or operational reasons is not treated as a failure to provide the service where a reasonable alternative of comparable character can be supplied.
If we decide that the booked water activity cannot be provided safely and no reasonable alternative is suitable, we will offer a transfer to another available date or a refund of the affected service price. We are not responsible for separate travel or accommodation costs unless required by law.
6. Customer cancellation and date-specific leisure services
Diving excursions are leisure activities arranged for a specific date or period. Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, the usual statutory cooling-off right may not apply to a contract for a leisure service where the contract provides for a specific date or period of performance.
Our voluntary cancellation policy applies unless your written confirmation states a more favourable term: cancellation received at least 14 clear days before the booked date receives a refund of the service price paid; cancellation 7 to 13 clear days before the booked date receives 50% of the service price paid; cancellation less than 7 clear days before the booked date is non-refundable. We will consider reasonable requests to transfer a booking where space and operational planning allow.
If you cannot participate because required qualifications, medical clearance or equipment conditions are not met and we were not told in time to make a reasonable alternative arrangement, the booking may be treated as a customer cancellation.
7. Arrival, equipment and conduct
You must arrive at the time stated in the confirmation with any required certification evidence, personal equipment and documentation. Equipment you bring must be suitable for the planned activity and maintained appropriately. Any hire equipment must be used in accordance with the briefing and returned in the condition in which it was supplied, allowing for normal use.
Participants must follow the dive plan, surface instructions, boat rules and reasonable directions given for safety. We may refuse or end participation where behaviour, intoxication, unsafe conduct, material misrepresentation or disregard of instructions creates an unacceptable risk. This does not affect rights that cannot lawfully be excluded.
8. Risk, responsibility and liability
Scuba diving is an activity with inherent risks, including risks associated with pressure, breathing gases, weather, currents, entries and exits, boats, underwater structures and the marine environment. Following a briefing or dive plan cannot remove all risk. Participants remain responsible for acting within their training, experience and the agreed plan.
Nothing in these terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any statutory consumer right that cannot be excluded. Subject to those protections, each party is responsible for losses that are a reasonably foreseeable consequence of its breach of contract or failure to use reasonable care.
9. Force majeure and matters outside reasonable control
We are not responsible for delay or failure caused by events outside our reasonable control, including severe weather, harbour restrictions, emergency instructions, sudden vessel unavailability, closure of access points or other events that could not reasonably be avoided. Where such an event affects a booked activity, we will communicate the position and offer the remedies required by law and the relevant booking terms.
10. Website information and intellectual property
We aim to keep prices and descriptions current, but diving conditions and operational details can change. Website text, design and original editorial material are owned by or licensed to Dive Beyond LTD and may not be reproduced commercially without permission. Links, if provided, must be used for their stated destination and must not be presented as an endorsement that has not been given.
11. Complaints, governing law and contact
If you have a concern, contact Dive Beyond LTD using the email, telephone number or postal address above and give enough detail for us to investigate. We will try to resolve service issues directly and fairly.
These terms are governed by the laws of England and Wales. If you are a consumer resident elsewhere in the United Kingdom, mandatory rights and applicable jurisdiction rules are not affected by this clause.
